Conditions of Issue of a BWFC Season Ticket

1. Issue of a Season Ticket "TeamCard"

1.1 The issue of a TeamCard and subsequent access to the Ground is subject to the Terms & Conditions of Entry.

1.2 The Terms & Conditions of Entry can be found at every turnstile block at the Reebok Stadium, the official Club website or can be provided upon written request to the Club

1.3 If the following Conditions of Issue are not accepted, the TeamCard should be returned immediately and intact. The use of a TeamCard to gain entry to the Ground will be considered to constitute acceptance of these conditions.

1.4 TeamCard is for the use of supporters of the Club only. By applying for a TeamCard and/or using the same you hereby warrant and represent that you are a supporter of the Club. The BWFC TeamCard is intended for use by bona fide supporters of Bolton Wanderers Football Club and is not for use by supporters of the visiting club.

1.5 This TeamCard remains the property of the Club at all times and its use is subject to compliance with the Terms and Conditions of Entry set out below.

2. Admission to the Ground

2.1 Use of a TeamCard constitutes acceptance of the Terms & Conditions of Entry.

2.2 A TeamCard permits you to occupy at the Match the seat indicated on the TeamCard or such other alternative seat of equivalent value as the Club may, from time to time, allocate to you at its reasonable discretion.

2.3 Nothing in these Conditions of Issue shall constitute or imply any entitlement to occupy the seat indicated on the TeamCard in any subsequent season.

2.4 Save as set out in clause 2.5 below, you shall not bring into (or use within) the Ground any equipment which is capable of recording or transmitting (by digital or other means) any audio, visual or audio-visual material or any information or data in relation to a Match or any aspect of it. Any person acting in breach of this provision may have such equipment confiscated and/or will be required to deliver up any tapes, films, disks or other recordings or data to the Premier League (PL) and/or the Club and the copyright in any such recording or transmission is hereby assigned (by way of present assignment of future copyright pursuant to section 91 of the Copyright, Designs and Patents Act 1988) to the PL.

2.5 Mobile phones are permitted within the Ground, provided that they are used for personal and private use only.

2.6 Save for official Club merchandise and/or other football related clothing worn in good faith, you shall not bring into, use or display within the Ground any sponsorship, promotional or marketing materials.

2.7 The Club reserves the right to:

  • Temporarily suspend this TeamCard service from any person at any time for minor contravention of any of the conditions or regulations created in accordance with this clause without refund or redress.
  • Permanently withdraw this TeamCard service from any person at any time for a major contravention of any of the conditions or regulations created in accordance with this clause without refund or redress.

2.8 You shall not offer or distribute (either free or for sale by any person) within the Ground any consumer articles or commercial product of any nature. For the avoidance of doubt this clause shall not prevent the lawful distribution of text publications in any format which do not infringe clause 2.6 where both the content and the publication are lawful in all respects and do not in the Club's reasonable opinion constitute a threat to public order.

2.9 The Club reserves the right to refuse admission to, or eject from, the Ground any person who fails to comply with the Terms and Conditions of Entry.

2.10 Without prejudice to the representation at clause 1.4 above, and in light of the Season Ticket holders being grouped together in designated areas, any attempt to gain access to the ground wearing or carrying apparel (including, without limitation, hats and/or scarves) that demonstrate support for the Away Club, may result in admission being refused or you being ejected from the Ground and in such circumstances no refund or alternative seat will be offered.

2.11 Supporters should, where possible, refrain from bringing bags and rucksacks into the Ground - the Club reserves the right to search any spectator who has a bag on their person.

2.12 Children under the age of 14 must be accompanied by an adult.

2.13 A valid TeamCard must be produced to gain access to the Ground and, having entered the Ground, there will be no pass outs or readmission of any kind.

2.14 As part of the Terms and Conditions of Entry the Club reserves the right to take photographs of supporters within the Stadium for use in Marketing literature and club publications.

2.15 This TeamCard season ticket admits the holder only to Matches played by Bolton Wanderers Football Club at the Reebok Stadium in the Barclays Premier League season 2011-12.

3. Use of TeamCard

3.1 TeamCards are issued for your sole use and you shall not resell or (save as set out in clause 3.2 below) transfer or lend the TeamCard to any other person without the prior written consent of the Club. The reference to selling the TeamCard includes offering to sell a TeamCard (including without limitation, via an online auction website), exposing a TeamCard for sale, making a TeamCard available for sale by another and advertising that a TeamCard is available for purchase. For the avoidance of doubt (and by way of example only) this TeamCard may not be offered as a prize in any promotion or competition nor transferred, lent or sold to any third party as part of a hospitality or travel package, given to a third party who agrees to buy another good or service, or used for any other commercial purpose, save as expressly authorised by the PL or the Club.

3.2 You may only resell or transfer the TeamCard to a Guest with the express written consent of the Club given at the Club's absolute discretion. No such resale or transfer will be permitted except where the same takes place in respect of an individual match and in consideration of no payment or benefit in excess of the face value of a ticket to that Match and such transfer does not take place during the course of any business or for the purpose of facilitating any third party's business. Such resale or transfer to any Guest will be subject to the Terms and Conditions of Entry which will (save for any rights to transfer under this clause) apply to that Guest as if he/she was the original purchaser of the TeamCard (and you must inform the Guest of this).

3.3 The Club reserves the right to offer to TeamCard holders the opportunity to 'sellback' their TeamCard for individual Matches selected at the discretion of the Club. The Club retains the right to sell on these seats for these selected games.

3.4 The unauthorised sale or disposal of tickets is a criminal offence under section 166 of the Criminal Justice and Public Order Act 1994, as amended by the Violent Crime Reduction Act 2006. The Club will inform the police when it becomes aware that TeamCards are being sold illegally and will press for charges to be brought against those breaking this law. If you are convicted of a ticket touting offence, or we reasonably suspect you have committed such an offence, we will notify the PL who may in turn notify other Premier League clubs and/or the relevant law enforcement authorities. The information that we share may include your personal details, information about the offence and about ticket purchases (including payment details). We will use this to identify and prevent ticket touting offences and disorder at matches.

3.5 The TeamCard will remain the property of the Club at all times and must be produced together with evidence of your identity if required to do so by any official, steward or employee of the Club or any police officer. The Club reserves the right to require the immediate return of the TeamCard at any time.

3.5.1 Persons holding a concessionary priced TeamCard (see clause 9.2.2) MUST bring identification evidence of their concessionary status with them when attending Matches. This must be produced on demand to any steward, police officer or agent of the Club. Those persons not in possession of relevant I.D. will be refused entry and will need to obtain an upgrade from Bolton Central.

3.6 Any TeamCard obtained or used in breach of the Terms & Conditions of Entry shall be void and all rights conferred or evidenced by such TeamCard shall be nullified. Misuse of this TeamCard may result in the holder being ejected from the Ground in respect of a particular Match and/or the cancellation and withdrawal of this TeamCard. In the event of any cancellation and withdrawal in accordance with clauses 2.7 and 3.4, no refund shall be payable to the holder in respect of any unexpired portion of the TeamCard. The Club further reserves its right to take any legal or disciplinary action against any person(s) as it sees fit in connection with such matters, including a claim for an account of any profits made from an unauthorised use of the TeamCard.

3.7 The Club reserves the right to revoke without refund or redress the TeamCard season ticket of any person who:-

3.7.1 Persistently contravenes Ground Regulations published by the PL. Copies of the Ground Regulations are located at each turnstile block at the Reebok Stadium, are available on request and are displayed online at www.bwfc.co.uk.

3.7.2 Is ejected from the Ground for contravention of Ground Regulations on more than one occasion.

3.7.3 Is found guilty by a court of law of any football related offence.

4. Changes to Dates, Refunds & Exchanges

4.1 Dates and times of kick off will be announced in Club publications, on the BWFC website and/or via the media. However, on occasion, the dates and times of matches may be altered at short notice without liability upon the Club.

4.2 No guarantees can be given by the Club that a Match will take place at a particular time or on a particular date. The Club reserves the right to reschedule any Match without notice and without any liability whatsoever. Your TeamCard will enable you to attend the rearranged Match. The Club will endeavour to give as much notice as possible if there are changes. However, changes may be determined by other parties outside of the reasonable control of the Club. Once a match has been played no refunds will be granted.

4.3 The Club will have no further liability whatsoever, including (but not limited to) any direct or consequential loss or damage, loss of enjoyment or travel/accommodation costs.

4.4 Should a match be abandoned following admission to the stadium but before kick-off, supporters will be entitled to free admission to the rearranged match. Should a match be abandoned after kick-off for reasons beyond the reasonable control of the Club, and the match subsequently rearranged, supporters will be entitled to half-price admission.

4.5 No refund can be made in respect of matches where the TeamCard has not been used to gain entry to the Ground.

5. Lost or Stolen TeamCards

5.1 In order to gain admission to the Ground the TeamCard must be presented in its entirety at every Match. The Club cannot accept any responsibility whatsoever for TeamCards which are lost, stolen, forgotten or destroyed. A replacement TeamCard will be issued for an administration fee of £5 per TeamCard.

5.2 If in the event that a TeamCard is forgotten, lost or stolen on any given matchday, the same seat will only be offered at the Club's discretion. The Club also reserves the right to charge a non refundable administration fee of £5 for this replacement service.

5.3 If, in the Club's opinion, a TeamCard is damaged, lost, stolen or destroyed, a duplicate TeamCard shall be issued by the Club as soon as reasonably practicable after the payment of a non refundable administration charge. Only one duplicate TeamCard will be issued to you per season and you will be required to sign a document confirming that the original TeamCard is damaged, lost, stolen or destroyed and indemnifying the Club against any direct or indirect consequences of such matter having been falsely represented or stated to the Club.

5.4 Should any TeamCard when applied for not arrive in the post after purchase you will be required to sign a document confirming this and undertaking to immediately return the original TeamCard to the Club should it come into your possession at any time. There will be no charge for the issue of a duplicate TeamCard in this instance.

6. Change of Address

6.1 If you change your address during the season you must notify the Club as soon as possible. Please contact Bolton Central with any change of address details or email changeofaddress@bwfc.co.uk

7. Cancellation & Withdrawal of TeamCard

7.1 Without prejudice to any other remedies it may have, the Club shall have the right in the case of any serious or persistent breach of these Terms & Conditions of Entry to cancel and withdraw your TeamCard. In the event of such cancellation no refund will be paid in respect of any unexpired portion of the TeamCard. Without prejudice to the general nature of the above the following actions shall constitute serious breach of Terms & Conditions of Entry:

7.1.1 Smoking inside the Ground (see clause 10);

7.1.2 being (or appearing) to be intoxicated;

7.1.3 Persistent standing in seated areas whilst the Match is in progress;

7.1.4 Sale or transfer (save as permitted) of this TeamCard to any person;

7.1.5 the possession of a banner or flag that bears material or slogans that are offensive, obscene, abusive or racist;

7.1.6 the supply of any misleading or incorrect information in any application;

7.1.7 the use of foul, obscene, abusive and/or racist language and/or gestures;

7.1.8 the throwing of any object within the Ground that may cause injury or damage to people or property without lawful authority or excuse;

7.1.9 the chanting of anything of indecent, racist or homophobic nature;

7.1.10 any misrepresentation in relation to clause 1.4;

7.1.11 Breach of terms of any Membership;

7.1.12 any breach of clauses 2.4 or 2.5 above; and

7.1.13 any failure to pay or default of payment in respect of any sums owing to the Club (or 3rd party) in respect of this TeamCard.

7.2 In the event that your TeamCard is withdrawn or cancelled the Club reserves the right to exclude you from any membership scheme maintained or organised by the Club and/or to disqualify you from applying for any Match ticket or season ticket at its discretion. Your name, identifying details and/or any photographs of you (including, but not limited to any material being personal and/or sensitive personal data as defined under the Data Protection Act 1998) may be passed to the police and/or such other appropriate authority as the Club sees fit.

8. Exclusion of Liability

8.1 To the maximum extent permitted by law, the Club hereby excludes any liability for loss, injury or damage to persons/property in or around the Ground except in respect of death or personal injury resulting from any negligence of the Club.

8.2 Neither the PL nor the Club shall be responsible for any interruptions and/or restrictions to the view of the Match caused by virtue of (i) the position of the seat and/or (ii) the actions of other spectators.

9. General

9.1 The invalidity or partial invalidity of any provision of these Conditions of Issue shall not prejudice or affect the remainder of these Conditions of Issue, which shall continue in full force and effect.

9.2 Notwithstanding any other provision in these Conditions of Issue and with the exception of FIFA, UEFA, The FA, PL and the Football League, no other person other than you or the Club has any rights under the Contracts (Rights of Third Parties) Act 1999 to rely on or enforce any term of these Conditions of Issue. Nothing in these terms of conditions shall affect any right or remedy of a third party that exists or is available other than as a result of the aforementioned Act.

9.3 These Conditions of Issue shall be governed by and constructed in accordance with the laws of England and Wales. The parties hereby submit to the exclusive jurisdiction of the Courts of England and Wales (including in relation to any non-contractual disputes or claims).

10. Cup and Away Matches

10.1 For all home Cup ties, arrangements for the TeamCard Season Ticket Holders will be advertised in Club publications, on the BWFC website and/or via the media. The Club will take all steps to ensure allocation of your own seat if required, provided that the application is made in the advertised manner and that the seating for this match is not declared unreserved and all season ticket holder areas of the Stadium are open for the match.

10.2 For all home and away Cup matches and FA Premier League away matches, BWFC TeamCard holders will be given preferential access to match tickets subject to availability in the following order of priority. However, no guarantee of allocation can be given. i) TeamCard Season Ticket Holders ii) Holders of Lifeline Membership or BWFC Official Membership iii) Open sale BWFC cannot guarantee allocation in such circumstances where ticket allocation and volume is determined by a 3rd party and/or where demand is likely to exceed supply.

10.3 For certain high-demand games (i.e. where potential demand is likely to exceed supply in the judgement of the Club), BWFC will operate a voucher system, details of which will be advertised in Club publications, on the BWFC website and/or via the media. In such circumstances, the Club reserves the right to vary the priority schedule detailed above.

10.4 All tickets are subject to availability and are limited to one ticket per person unless otherwise stated.

10.5 Any variations or additions to the foregoing will be announced in Club publications and/or the BWFC website and/or via the media as and when necessary.

10.6 TeamCard Season Ticket Holders, who choose to take advantage of our automatic issuing of Cup match tickets service, must complete the credit/debit card section of the Season Ticket application form. For "reserved seating" Cup matches, the Club will automatically renew existing seating arrangements. For "unreserved seating" Cup matches, the Club will issue tickets on a likefor- like basis.

10.7 When purchasing the ticket, customers must be in the possession of their TeamCard and vouchers (where applicable). Refusal will be at the discretion of Club staff if the customer is not in possession of the aforementioned items.

11. Direct Debit Payment Scheme

11.1 If you have elected to pay for your season ticket through the direct debit payment scheme, please refer to the terms and conditions of that scheme on the direct debit scheme application form (available on the Club's website, in the season ticket application pack or available form the Club on request), which are deemed to be incorporated into these Conditions.

12. Promotions and Concessions

12.1 The Club reserves the right to offer a limited number of selected low demand matches at reduced rates to non season ticket holders to boost attendance and attract new supporters to the Club.

12.2 The Club reserves the right to offer concessionary priced tickets to the following groups providing that they meet the appropriate criteria:-

12.2.1 Senior Citizens who are 65 or over at 14/08/2011. This applies to men and women regardless of whether they are of 'pensionable age' or not.

12.2.2 Young persons who are between 18-21 years of age at 14/08/2011 and who can provide photographic evidence containing proof of date of birth.

13. Smoking Policy

13.1 Smoking is not permitted in any area of the Stadium in accordance with government legislation. This includes all seating areas, stadium concourses and piazza areas.

14. Governing Law

14.1 These Conditions of Issue shall be governed by and constructed in accordance with the laws of England and Wales. The parties hereby submit to the exclusive jurisdiction of the Courts of England and Wales.

15. Definitions

In the Conditions of Issue the following words and phrases shall have the following meanings:

"Away Club" means the football club playing against Bolton Wanderers FC.

"Conditions of Issue" means these terms and conditions governing the issue and use of a TeamCard.

"Ground" means the football stadium and all other locations owned, occupied or utilised by the Club.

"Club" means Bolton Wanderers Football and Athletic Company Limited.

"Ground Regulations" means those ground regulations issued by the Club from time to time that set out the terms and conditions upon which spectators are granted entry to the Ground (copies of which are displayed at turnstile entry points and are available online or by request).

"Guest" means a relative, friend, colleague and/or companion to the disabled who would be entitled to purchase a Season Ticket under the Terms and Conditions of Entry.

"Match" means any FA Premier League football match in which the Club participates and that takes place at the Ground during Season 2011-2012.

"TeamCard" means a season ticket smartcard (and/or any rights arising out of or in connection with any of the foregoing) for admission to Matches.

"Terms & Conditions of Entry" means each of the rules and regulations of FIFA, UEFA, The Football Association, The Football Association Premier League Limited ("PL") and The Football League; the Ground Regulations; and the Conditions of Issue.
